Terms of Service

These Terms govern your access to and use of lupa. — the positioning intelligence platform. By using lupa., you agree to these Terms. Please read them carefully.

Who these Terms apply to

These Terms apply to all users of lupa., including creators who complete the positioning diagnostic, brands who access lupa. intelligence, and agencies who use lupa. on behalf of clients. “lupa.,” “we,” “us,” and “our” refer to Culture-Watch LLC, a New York company.

By creating an account or using any part of the lupa. service, you confirm that you are at least 18 years old and have the authority to enter into a binding agreement.

What lupa. provides

lupa. is a positioning intelligence platform that analyzes how creators are interpreted by markets, audiences, and brands. The service has three parts:

The First Read (free). A read of your own public work, run at your initiation. A partial result is shown in chat; the full document is delivered by email. One First Read per handle; you may re-run it after 90 days.

The Positioning Brief (one-time purchase). A full positioning analysis, delivered on completion of the 35-question diagnostic. The Positioning Brief is $450 (up to two platforms, standard corpus). The Extended Brief is $950 (three or more platforms, or a large corpus). Each additional minor account is $150; larger scopes are priced by quote. Every Brief includes one month of lupa Pro membership from the date of purchase.

How your corpus is counted. Your corpus is counted from the handles you provide, before checkout. If it counts larger than the tier you booked, we tell you at intake, before any reading begins — you may pay the difference or trim the scope. If we discover the difference mid-read, we absorb it and complete the Brief at the booked price. If you booked the Extended Brief and your corpus counts as standard, we refund the $500 difference automatically.

Membership (optional). lupa Pro is $69 per month and lupa Max is $119 per month, billed monthly in USD. Renewal is opt-in: each cycle requires your affirmative choice, and nothing renews on its own. There is no free membership tier.

lupa. provides intelligence and analysis — not career advice, financial advice, or guarantees of brand partnerships or business outcomes. Diagnostic outputs reflect our analytical interpretation of publicly available signals and information you provide. They are not endorsements, guarantees, or predictions.

Your account

You are responsible for maintaining the security of your account and for all activity that occurs under it. Do not share your credentials with others. Notify us immediately at hello@culture-watch.com if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform in ways that harm other users or the integrity of our service.

Content you provide

By submitting content to lupa. — including social media handles, connected accounts, diagnostic responses, and any other information — you grant lupa. a limited license to use that content to provide and improve the service.

You retain all ownership of your content. We do not claim any intellectual property rights over the materials you submit. We will not share your individual content, diagnostic results, or personal data with third parties except as described in our Privacy Policy.

Put-forward consent.No read, score, or dossier concerning you is ever visible to, sold to, or shared with any brand or third party unless you give recorded, affirmative “put me forward” consent. Each consent covers one version of your dossier, for one named brand or one category of brands you define; it is logged and timestamped, and you may revoke it at any time before the dossier is delivered. Visibility to brands is never a default. A brand that receives your dossier is bound to confidentiality and may not reuse it.

You are responsible for ensuring that any content you submit does not infringe third-party rights and that you have the right to share it with us for analysis purposes.

lupa.’s intellectual property

The lupa. platform, diagnostic framework, report structure, signal taxonomy, and all related methodology are the intellectual property of Culture-Watch LLC. These Terms do not grant you any right to reproduce, distribute, or create derivative works based on lupa.’s methodology, frameworks, or platform design.

Your positioning Brief is yours. You may share it, reference it, and use it to inform your own strategy. You may not resell, license, or distribute it as a product or service.

Permanence. Delivered documents — your First Read and your Positioning Brief — are yours to keep as downloadable files (PDF). Hosted access to your documents on the platform continues for the life of the service. Closing your account or ending a membership does not take a delivered document away from you.

Payments, renewal, and refunds

Pricing is displayed at the point of purchase. All payments are processed by our third-party payment processor, in USD.

One-time purchases. The Positioning Brief is a one-time purchase, not a subscription. It includes one month of lupa Pro from the date of purchase. That included month does not convert into a paid membership: when it ends, nothing is charged unless you affirmatively choose to continue.

Membership renewal is opt-in. lupa Pro and lupa Max are billed monthly. Each billing cycle requires your affirmative choice to renew — we never charge a stored payment method without it. If you do nothing, your membership simply ends at the close of the paid month.

Delivery. Your Positioning Brief is delivered on completion of the 35-question diagnostic. If it is not delivered on completion, we will complete it promptly or refund your purchase in full.

Refund policy.

Limitation of liability

lupa. is provided “as is.” We make no warranties, express or implied, about the accuracy, completeness, or fitness for purpose of any diagnostic output or strategic recommendation.

To the fullest extent permitted by law, lupa.’s total liability to you for any claim arising from your use of the platform shall not exceed the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or personal injury caused by our negligence.

Dispute resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of lupa. shall be resolved by binding arbitration in New York, NY, administered under the rules of the American Arbitration Association, except that either party may seek emergency injunctive relief in court.

You waive any right to participate in a class action lawsuit or class-wide arbitration against lupa.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date above. If changes are material, we will notify you by email at least 14 days before they take effect. Your continued use of lupa. after the effective date constitutes acceptance of the revised Terms.

If you do not agree with the revised Terms, you may close your account before they take effect.
